JEREMY ROSENTHAL takes a look at some of the legal stories making headlines in this weekly segment:
TOPIC 1- WHAT WILL HAPPEN TO TRUMP'S LEGAL ISSUES AFTER THE ELECTION?
Whether Trump wins or loses, the 2024 election results could affect the outcomes of his civil and criminal cases. Donald Trump has more than just the presidency on the line Nov. 5 — the outcome of his various legal troubles hinges on the election, as well. A win in the election he’s dubbed “the most important“ in the history of the country would likely result in the federal criminal cases against him being dismissed, with state criminal cases possibly being frozen until he leaves office and additional delays in the various pending civil cases against him. A loss to Vice President Kamala Harris, however, could see Trump facing a potential jail sentence later in the month for his criminal conviction in New York and the possibility of additional criminal trials in 2025. It could also leave him open to additional civil trials in the near future, while he’s already appealing $500 million in civil judgments against him.
TOPIC 2- ELON MUSK LAWYER SAYS $1 MILLION VOTER GIVEAWAY WINNERS ARE NOT RANDOM
Elon Musk's pro-Trump group does not choose the winners of its $1 million-a-day giveaway to registered voters at random, but instead picks people who would be good spokespeople for its agenda, a lawyer for the billionaire said. Musk lawyer Chris Gober was trying to persuade a Pennsylvania judge that the giveaway was not an "illegal lottery," as Philadelphia district attorney Lawrence Krasner alleged in a lawsuit seeking to block the contest ahead of Tuesday's U.S. presidential election. Liberal San Francisco is hardly a hotbed of anti-COVID vaxxers – more than 90% of the city’s population got the shot, according to government data, opens new tab. That’s partly why I found a verdict, opens new tab by a San Francisco federal jury last week in favor of six public transit workers who were fired for refusing to comply with their employer’s COVID-19 vaccine mandate on religious grounds so unexpected. Jurors awarded the Bay Area Rapid Transit, or BART, ex-employees more than $1 million each for workplace civil rights violations, for a total of $7.8 million.
TOPIC 3- TRUMP SUES CBS NEWS FOR $10 BILLION ALLEGING 'DECEPTIVE DOCTORING' OF HARRIS' '60 MINUTES' INTERVIEW
CBS practices 'news distortion' intended to 'confuse, deceive and mislead the public,' the lawsuit says. Former President Trump is suing CBS News for $10 billion in damages, stating the network practiced "deceptive conduct" for the purpose of election interference in its interview with Vice President Kamala Harris. Fox News Digital exclusively obtained the lawsuit filed. Trump attorneys said the complaint comes due to "CBS’ partisan and unlawful acts of election and voter interference through malicious, deceptive, and substantial news distortion calculated to confuse, deceive, and mislead the public."

ELECTION DAY
We throw the word 'historic' around a lot during elections, but this one really is without precedent. If Kamala Harris wins, she'll enter the White House as not just the first female US president, but the first black woman and Asian American president too. And for Donald Trump, he could be the first president since the 19th century to win having lost a re-election bid, and the first of a major party with a criminal conviction. Plus let's consider what it took for us to get to this point - assassination attempts on Trump and President Joe Biden forced out the race. Major pollster drops final battleground poll numbers. Harris hold slim leads in four of the seven main battleground states. The final New York Times/Siena College Battleground poll of the 2024 race shows a razor-tight election in the battleground states just days before the election. Former President Trump leads Vice President Kamala Harris in Arizona, while Harris enjoys a lead in Georgia, North Carolina, Nevada and Wisconsin. Michigan and Pennsylvania are tied between the two candidates, according to the poll. In Arizona, the only state where Trump has a lead, the former president is up four points on Harris, 49-45. Meanwhile, Harris has a one-point lead in Georgia (48-47),two points in North Carolina (48-46), three points in Nevada (49-46) and two points in Wisconsin (49-47). For Trump, early voting shows Republicans are voting in greater numbers than Democrats. The former president's getting a historic number of young male voters who are traditionally Democrat. Mattias Gugel - Vote NO on Measure

New Op-Ed: The $1,600 rebate trap: How Measure 118 will increase daily cost of life of Oregonians (Bend Bulletin)
Ballot Measure 118, which would slap a new tax on businesses in Oregon and end up raising prices for Oregonians.
Expert/Guest: Mattias Gugel is the Director of State External Affairs at National Taxpayers Union (NTU)
POV:
Ballot Measure 118 proposes a new tax on large businesses to fund a $750 annual rebate for every Oregonian. This is will only drive up the costs of life essentials.
Measure 118 is a Trojan horse for higher costs on essential items — groceries, rent, utilities. A short-term rebate won’t erase the permanent price hikes or future taxes needed to fund it. Don’t trade short-lived relief for years of hardship.
Introducing a tax on gross revenue will have unintended consequences. Businesses with thin profit margins, like grocery stores and local retailers, will be taxed on total sales, not profits.
A typical Oregon grocery store operates with an average net profit margin of slightly more than 1 percent. On a grocery store bill of $100, its profit is slightly more than a dollar. Under Measure 118, the store would be taxed $3 for that one grocery bill. This is about triple the store’s profit, just for the new tax created under this ballot initiative.
To cover this additional cost, businesses will likely raise prices. So, while a “free” $750 check might sound fantastic, it’s not so thrilling when you’re shelling out more for your morning pour-over and produce at the neighborhood co-op.
Measure 118 is anything but fair. Middle- and lower-class Oregonians will end up paying the price. You’ll see your grocery bill and rent go up, and what will you have to show for it? More government control, taxes, and less of what matters — freedom and opportunity.
Voters should reject Measure 118 at the ballot box and focus on policies that foster prosperity and opportunity for all. Oregonians deserve policies that deliver lasting prosperity, not fleeting rebates followed by long-term pain.
Oregon’s history has shown that, once a government program starts, it rarely shrinks and often tends to grow. This could lead to future tax hikes to cover the increasing costs of the rebate program, leaving Oregonians to pick up the tab.
